How CuePad handles copyright infringement claims

CuePad respects the intellectual property rights of others and expects users of the Service to do the same.
If you believe that content made available through CuePad infringes your copyright, you may submit a notice to us as described below.
CuePad is operated by Ximon Software, LLC, located in Florida, United States. Copyright notices should be sent to support@cuepad.app.
1. Filing a Copyright Complaint
If you believe content accessible through CuePad infringes your copyright, please send a written notice to support@cuepad.app that includes:
- your full name and contact information;
- a description of the copyrighted work you claim has been infringed;
- a description of the allegedly infringing material and information reasonably sufficient to help us locate it;
- a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner;
- your physical or electronic signature.
2. CuePad Response
Upon receiving a valid copyright complaint, CuePad may:
- remove or disable access to the allegedly infringing material;
- notify the user who uploaded the material;
- take additional action as appropriate under applicable law.
CuePad reserves the right to remove or disable access to content that allegedly infringes copyright without prior notice.
3. Counter-Notification
If you believe that material you uploaded was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification.
A counter-notification must include:
- your name, address, telephone number, and email address;
- identification of the material that was removed or disabled and the location where it appeared before removal;
- a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- a statement that you consent to the jurisdiction of the federal court in the judicial district in which your address is located, or if outside the United States, the courts located in Palm Beach County, Florida;
- your physical or electronic signature.

CuePad may suspend or terminate accounts of users who are determined to be repeat copyright infringers, consistent with applicable law.
5. Misrepresentations
Submitting false claims in a copyright complaint or counter-notification may expose you to liability for damages, including costs and attorneys' fees, under applicable law.
